DWI Conviction for Henderson

County Court at Law #4 Presiding Judge Jerry Bussell convicted Alan Henderson of Driving While Intoxicated on June 29, 2017 after a trial before the Court. The 27-year-old Missouri City man was charged with the crime after being stopped for speeding on Highway 90 in 2012.

According to Assistant District Attorney Drew Kwartler, Missouri City Police Officer Jessica Berry stopped Henderson as he was speeding down Highway 90 near 2:00 a.m. on October 4, 2012. Officer Berry immediately smelled the odor of alcohol as she approached the vehicle, speaking with Henderson and his three passengers. The officer evaluated the defendant’s sobriety using standardized sobriety tests, but Henderson performed poorly and was arrested for Driving While Intoxicated. Henderson agreed to provide a breath sample which showed his blood alcohol content to be .140 – almost twice the legal limit in the state of Texas.

“The evidence of intoxication was clear,” said lead prosecutor Drew Kwartler. “Thankfully, this DWI ended in an arrest, rather than an accident or injury.”

Driving While Intoxicated in this case is a Class B Misdemeanor punishable by a fine up to $2,000 and/or up to 180 days in jail. Henderson was not probation eligible.

Assistant District Attorneys Drew Kwartler and Bryan Honeycutt prosecuted the case. Attorney Lisa Gonzalez represented the defendant.
