DWI COURT
The Court has two different DWI Court Programs, Tier 1 and Tier 2. Both programs are entirely separate from the District Attorney’s Office Safe Start Program.
TIER 1
DWI Court Tier 1 is the Court’s Pre-Trial Diversion Program, which is intended for first time DWI offenders. After the DWI Court Officer approves the Defendant for DWI Court, the Defendant will enter into a contract. The Defendant will then be under the guidance of one of the DWI Court Staff Attorneys. The Judge can remove the Defendant from the DWI Court Program at any time. If the Defendant is removed from DWI Court, the Defendant’s case will be transferred back to the original court, and it will be the Defendant’s previous attorney’s responsibility to contact the original court to be scheduled back on the Court’s docket. If a Defendant is eligible and successfully completes DWI Court, the Defendant’s case will result in a dismissal. Below are links to access more information regarding DWI Court Tier 1.
TIER 1 CONTRACTS
The Court will contact the attorney to provide the contract and to schedule a court date to finalize the DWI Contract. The Defendant MUST appear in court to be sworn by the Clerk and to obtain a fingerprint. DWI Court Tier 1 contracts MUST be emailed to the Court at Court6Criminal@fortbendcountytx.gov no later than 2 business days before the scheduled court date.
TIER 2
The Court’s DWI Court Tier 2 Program is intended for Defendants that have had a previous DWI conviction. After the DWI Court Officer approves the Defendant for DWI Court, the case will be transferred to Court 6, and the Defendant will enter a Probation plea into DWI Court. The Defendant will then be under the guidance of one of the DWI Court Staff Attorneys. The Judge can remove the Defendant from the DWI Court Program at any time. If the Defendant is removed from DWI Court, a MRP will be filed and a warrant will be issued for the Defendant’s arrest. The case will remain in Court 6, and the Defendant will receive a new court date once they have been arrested on the MRP warrant.
TIER 2 PLEAS
The DWI Court Prosecutor will email the plea paperwork to the Attorney. The plea paperwork MUST be completed by you and your client and emailed to the DWI Court Prosecutor no later than 2 business days before the scheduled plea date.
