Responsibilities of Aerobic OSSF System Owners
This letter is a courtesy reminder of the responsibilities of owners who have a permitted Aerobic OSSF system in Fort Bend County (FBC). It’s important to check our website for the most up-to-date information.
- It is the responsibility of the OSSF owner to ensure their maintenance contract is current and filed with Fort Bend County Environmental Health.
- There are maintenance contractors that will file on your behalf but is not required by State of Local laws or regulations. If you choose to have a maintenance contractor submit on your behalf and is late, the responsibility still lies on the owner of the OSSF system owner.
- After expiration of the initial two (2) year maintenance contract, each on-site sewage facility (ATU or other system requiring routine maintenance) must submit a renewing contract with an Annual Maintenance Contract Renewal Fee.
- As per TAC 285.7(d)(2): Contract submittals. Unless the owner maintains the system, as excepted by paragraph (4) of this subsection, a copy of the signed maintenance contract shall be provided by the owner to the permitting authority 30 days before the expiration of the initial two-year service policy. For the time period after the initial two-year service policy, the owner is required to have a new maintenance contract signed and submitted to the permitting authority at least 30 days before the contract expires.
- Failing to turn in a contract 30 days before the contract expires will result in a Notice of Violation
- As a reminder, per FBC regulations, All contracted maintenance of an on-site sewage disposal system using aerobic treatment shall be conducted by a certified maintenance provider. There shall be no homeowner/property owner maintenance of an on-site sewage disposal system using aerobic treatment unless the property owner/homeowner is a certified maintenance provider for that aerobic treatment unit.
- Contracts will not be accepted without the renewal fee (including any late fees) and must be paid at the time of submittal. Contracts for more than one year {Example: 2+} must pay the annual fee for each year of the contract. If this is submitted late then there will be a late fee associated the contract renewal fee.

- The current OSSF permit number must be identified on all contracts as well as signatures from both the maintenance provider and the owner.
- Contracts will not be accepted in the office. Contracts must be submitted online (https://myhealthdepartment.com/fbceh).
- Fees will be accepted online or in the office and will not be accepted by mail.
- There are no credits, refunds or substitutions for this fee. Contracts that are cancelled will require a new contract and another fee to be paid at the time of submittal.
- Any renewing contract without the fee(s) will be denied and returned.
